Fair Market Value Water & Wastewater Legislation and its impact on LPAs
North Carolina’s water and wastewater industry is highly fragmented, with an estimated 2000 municipal, authority and investor-owned community drinking water systems and wastewater systems. According to the North Carolina State Water Infrastructure Authority (SWIA), water and wastewater infrastructure needs across our state are estimated to range from $17 billion to $26 billion over the next twenty years to continue providing safe drinking water and wastewater services to residents of the state. Even with state and federal funding, the needs far outpace funding availability. A number of states have adopted fair market value legislation. In mid-2018, Fair Market Value (FMV) legislation was enacted in North Carolina. The law provides new guidelines to establish fair market value of water and wastewater utilities owned by counties, municipalities, or other governmental entities. The fair value determination enhances options for communities exploring the sale of their utilities to a regulated utility as a tool to address aged infrastructure. Rules were adopted by the North Carolina Utilities Commission (NCUC) in late 2020. We will discuss the fair market valuation of a utility system. The stakeholders involved: public utility companies, local governments, engineers, utility valuation experts and the NCUC. The various stakeholders’ interest and role in the fair market valuation process. Plus, I will provide a brief overview of Aqua North Carolina and our parent company Essential Utilities.
